Changes in the regulations on recycled plastics from 2024

The landscape of the excise tax on non-reusable plastic packaging is about to change. As of January 1, 2024, the amount of recycled plastic in products can no longer be credited in the excise tax through a responsible declaration signed by the manufacturer. The way to certify it will be subject to more rigorous regulations under the UNE-EN 15343:2008 standard or its equivalent.

Requirements and applications

Certifying entities must meet precise requirements. They must be recognized by the National Accreditation Entity (ENAC) or by the accreditation body of a member state of the European Union. In addition, for products manufactured outside the EU, validation from an internationally recognized body by ENAC will be required.

The tax regulation covers a range of products that include non-reusable containers with plastic, plastic products, semi-finished plastics intended for the manufacture of said containers, and products with plastic for the closure, marketing or presentation of non-reusable containers. The tax base will be calculated according to the amount of non-recycled plastic in kilograms in the products subject to the tax. Therefore, proper certification of the amount of recycled plastic becomes essential to avoid additional charges.

Towards a more rigorous system

The regulations that will apply from 2024 imply a transition towards a more rigorous certification system. This measure aims to guarantee the traceability and compliance of recycled plastic with specific standards.
